By August 2026 the Supreme Court had agreed to hear a case that could decide the future of lawsuits over energy companies' contributions to climate change.[3] The city and county of Boulder, Colorado, sued Exxon Mobil and Suncor Energy, arguing that they face rising costs from the effects of climate change.[1] Justice Samuel Alito recused himself in late September after calls to step aside over his stock holdings in oil companies.[2] At the arguments on October 5, the opening day of the court's term, the justices wrestled with whether the suits followed the path of corporate accountability cases or were a backdoor attempt to regulate greenhouse gas emissions.[4][1]
